Texans to vote on Constitutional Right to Farm

Texas voters will go to the polls on November 7 to determine the fate of 14 Constitutional Amendments. The first among these are Proposition 1, or the House Joint Resolution 126. The resolution proposes a constitutional amendment to “Protect a person’s right to engage in generally accepted farm, ranch, timber production, horticulture, or wildlife management practices on real property that the person owns or leases.” This amendment would require, for example, local governments to provide evidence that a regulation or law that would encroach on farmland or farm practices, endangers public health. It would also require city governments to provide ample reasoning before placing a ban on farming within a specified area.
